Pb. & Hyr. High Court: Custodial quizzing a must

Holding that human trafficking was “eating the society as white ant”, the Punjab and Haryana High Court has ruled in favour of custodial interrogation in such cases.
Rejecting anticipatory bail pleas filed against the State of Punjab by Mohali-based Bikram Singh Dhillon and Amitesh Bhatia, Justice Alok Singh asserted: “Nowadays human trafficking is a new type of offence, which is coming up and eating the society as white ant…. In my opinion, custodial interrogation seems to be must. Considering gravity of the offence, I am not inclined to grant extraordinary relief of anticipatory bail to the petitioners.”
The two were seeking bail in a cheating, forgery and criminal conspiracy case registered on May 19 under Section 406, 420, 465, 467, 468, 471 and 120-B IPC at Mohali police station.
The prosecution had claimed the petitioners were running a travel agency under the name of M/s Paragon Overseas at Phase II in Mohali. The complainant in the case paid Rs 4.10 lakh to the petitioners after they assured him of admission in a business management course in the UK.
The prosecution had claimed the petitioners applied for the complainant’s visa after filling up the forms and preparing the documents. But, the visa was rejected on the ground that the enclosures were found to be forged.
The complainant too was “debarred from making fresh application to obtain visa for 10 years. Also, the university in which complainant was to get admission was blacklisted and he could not be sent to the UK.
Appearing before the court, counsel for the petitioners argued that the petitioners had already refunded “handsome amount” to the complainant after deducting charges and expenses paid by them.
Elaborating on the grounds for rejection of the bail pleas, Justice Alok Singh observed: “In the opinion of this court, payment of amount by the complainant to the petitioners is admitted; blacklisting of the institute is also admitted; filling up the forms for obtaining visa by the petitioners is also admitted; visa was rejected having found enclosures forged is also admitted; not only this, complainant was debarred from making fresh application to obtain visa for 10 years is also admitted fact.” 

Chandigarh gets first woman SHO

Chandigarh, June 30
Inspector Poonam Dilawari, who rose from the rank of constable, today became the first woman police inspector in the history of the UT Police to be posted as Station House Officer (SHO). Inspector Dilawari, who assumed charge this evening as SHO of the Sector 3 police station, will be responsible for maintaining law and order and investigating crime in the city’s VVIP portion, which houses two state Governors and Chief Ministers, both Punjab and Haryana cabinet ministers, High Court judges, top rung bureaucrats and police officials in addition to the who’s who of the city.
Dilawari, who has so far spent 21 years with the Chandigarh Police, joined the force as a constable in 1990 and had cleared the assistant sub-inspector recruitment exam within the first year of her service (1991). She was promoted to sub-inspector in 1996 and then inspector in June, 2010.
She has held difficult assignments of in-charge of police posts in Sector 43, Dhanas village and Pulsora village. She has also been the in-charge of the Traffic Park in Sector 23. Last year, she became the first woman to be appointed as PRO of the UT Police.
“I am elated to be assigned this responsibility and will give it my best. It feels good to be the first woman SHO and my family has been supportive throughout,” said Poonam. In December last year, she was among three women non-gazetted officials (inspector level) to be selected for posting to a UN peace support mission. She has yet to be assigned for a UN posting.

Norms eased for Pak refugees

The Pakistani nationals living in India, who are not getting renunciation certificates from Pakistan to get Indian citizenship, now have got a ray of hope. In a communiqué to Rajya Sabha MP Avinash Rai Khanna, the Home Secretary, Government of India, has stated that Pakistani nationals living in India before December 31, 2004, will now be able to get Indian citizenship with a simplified procedure.
The Government of India has identified 7,635 such Pakistani nationals in the country, whose matter would be taken up on individual case basis.
Khanna added that the Pakistanis residing in India earlier had to get their renunciation certificates from Pakistani authorities but now the procedure has been simplified. “People would now be able to get the same from Indian authorities by simply submitting an affidavit”. Khanna had earlier written to the Government of India raising issue of granting Indian citizenship to the Hindus who have migrated from Pakistan due to various reasons.
Now, citizenship cases would be processed on a case-to-case basis considering an affidavit filed before the authority prescribed under rule 38 of the Citizenship Rule, 2009, as renunciation certificate. There are around 25 members of three families residing in Peer Colony area of Neelpur village in Rajpura. The families came to India in 1994 and since then they are doing menial jobs at Rajpura. “We are living without voter cards, ration cards and have got expired passports. We moved to India following riots near Loralai in Balochistan in 1994 wherein our houses were burnt,” said Rajesh.
Another Pakistani national, Lachhman Singh, said they had taken up the matter many a times with the Deputy Commissioner, senior Congress leaders and others, but nothing could be done. As per the letter, certain categories of foreigners (especially Pak nationals) have been exempted from the provisions of Passport (entry into India) Rules, 1950, to facilitate grant of long-term visa. The Indian government had also issued a gazette notification on May 15, 2010, in this regard.
However, the main problem was getting renunciation certificate, which Pakistani authorities issue. The ostensible reason behind their not issuing such a certificate was that most of the people did not possess computerised national IDs owing to the fact that when such field work was done in Pakistan, these people were already residing in India.

ਵੈਨਕੂਵਰ, 30 ਜੂਨ (ਗੁਰਵਿੰਦਰ ਸਿੰਘ ਧਾਲੀਵਾਲ)-30 ਸਤੰਬਰ 2010 ਨੂੰ ਇਥੋਂ ਦੇ ਕਲੀਅਰ ਬਰੁੱਕ ਰੋਡ 'ਤੇ ਸੜਕ ਪਾਰ ਕਰਦੇ ਸਮੇਂ 80 ਸਾਲਾ ਪੰਜਾਬੀ ਬਜ਼ੁਰਗ ਨੂੰ ਗੱਡੀ ਹੇਠ ਕੁਚਲ ਕੇ ਦੌੜਨ ਵਾਲੇ ਦੋਸ਼ੀ ਨੂੰ ਅਦਾਲਤ ਨੇ ਤਿੰਨ ਮਹੀਨੇ ਦੀ ਸਜ਼ਾ ਅਤੇ ਦੋ ਸਾਲਾਂ ਲਈ ਪ੍ਰੋਬੇਸ਼ਨਲ ਸਜ਼ਾ ਸੁਣਾਈ ਹੈ, ਜਿਸ ਵਿਚ ਗੱਡੀ ਚਲਾਉਂਦੇ ਸਮੇਂ ਸ਼ਰਾਬ ਦੀ ਵਰਤੋਂ ਨਾ ਕਰਨ, ਰਾਤ ਸਮੇਂ ਘਰੋਂ ਨਿਕਲਣ ਤੇ ਗੈਰ-ਪ੍ਰਵਾਨਿਤ ਡਰੱਗ ਆਦਿ ਨਾ ਲੈਣਾ ਸ਼ਾਮਿਲ ਹੈ। ਐਬਟਸਫੋਰਡ ਸੂਬਾਈ ਅਦਾਲਤ ਦੇ ਜੱਜ ਬੀ.ਡੀ. ਹੌਏ ਨੇ 27 ਸਾਲਾ ਦੋਸ਼ੀ ਕੇਨਥ ਹੌਵਰਥ ਨੂੰ ਸਜ਼ਾ ਸੁਣਾਉਂਦਿਆਂ, ਉਸ ਵੱਲੋਂ ਮ੍ਰਿਤਕ ਬਜ਼ੁਰਗ ਬਚਨ ਸਿੰਘ ਗਿੱਲ ਢੁੱਡੀਕੇ ਦੇ ਪਰਿਵਾਰ ਤੋਂ ਮੁਆਫੀ ਮੰਗ, ਪੰਜ ਹਜ਼ਾਰ ਡਾਲਰ ਮੈਮੋਰੀਅਲ ਲਈ ਪੇਸ਼ ਕਰਨ ਤੇ 'ਪਛਤਾਵਾ' ਕਰਨ ਆਦਿ ਗੱਲਾਂ ਨੂੰ ਅਹਿਮੀਅਤ ਦਿੱਤੀ। ਦੂਜੇ ਪਾਸੇ ਮ੍ਰਿਤਕ ਬਜ਼ੁਰਗ ਦੇ ਸਪੁੱਤਰ ਤੇ ਪੰਜਾਬੀ ਲਾਇਬ੍ਰੇਰੀਅਨ ਬਲਬੀਰ ਸਿੰਘ ਗਿੱਲ ਨੇ ਅਦਾਲਤੀ ਫੈਸਲੇ ਨੂੰ ਨਿਰਾਸ਼ਾਜਨਕ ਤੇ ਮੰਦਭਾਗਾ ਕਰਾਰ ਦਿੰਦਿਆਂ ਡੂੰਘੇ ਦੁੱਖ ਦਾ ਇਜ਼ਹਾਰ ਕੀਤਾ ਹੈ। ਸ: ਗਿੱਲ ਨੇ 'ਅਜੀਤ' ਨਾਲ ਗੱਲਬਾਤ ਕਰਦਿਆਂ ਕਿਹਾ ਕਿ ਉਨ੍ਹਾਂ ਦੇ ਸੇਵਾ-ਮੁਕਤ ਫੌਜੀ ਪਿਤਾ ਨੇ ਦੋ ਜੰਗਾਂ 'ਚ ਹਿੱਸਾ ਲਿਆ ਤੇ ਕੈਨੇਡਾ ਆ ਕੇ ਵੀ ਆਦਰਸ਼ਕ ਜੀਵਨ ਬਤੀਤ ਕੀਤਾ, ਜਦਕਿ ਕਥਿਤ ਦੋਸ਼ੀ ਨੇ ਅੰਨ੍ਹੇਵਾਹ ਗੱਡੀ ਚਲਾਉਂਦਿਆਂ ਉਨ੍ਹਾਂ ਨੂੰ ਟੱਕਰ ਮਾਰਨ ਤੋਂ ਮਗਰੋਂ ਘਟਨਾ ਸਥਾਨ ਤੋਂ ਭੱਜਣ ਦੀ ਵੱਡੀ ਗ਼ਲਤੀ ਕੀਤੀ ਤੇ ਇਸ ਲਈ ਉਸ ਨੂੰ ਵੱਧ ਸਜ਼ਾ ਮਿਲਣੀ ਚਾਹੀਦੀ ਸੀ।
