Parsvanath developers told to refund Rs 10.42 lakh

Chandigarh, September 2
The Chandigarh District Consumer Disputes Redressal Forum has asked Parsvanath Developers Limited to refund Rs 10.42 lakh deposited by a complainant as earnest money for allotment of a flat in the controversial Prideasia project.Delivering directions on the application of a Jaipur resident, the forum comprising president PD Goel and members Rajinder Singh Gill and Madanjit Kaur Sahota also directed the developer to pay 15 per cent interest per annum on the amount along with Rs 25,000 towards the
litigation cost.
“It’s a classic case where a consumer is being duped from all angles. The developer had been enjoying the benefit of the amount deposited by the complainant. They are not paying him any interest on the said amount and are not raising construction over the site. The developers are not in a position to handover the possession of the flat to him and when he asked for the refund of the amount, they are deducting half of the amount. The entire episode took place due to the unfair trade practice adopted by the developer in collecting the money, without getting any clearance from the authorities and without ascertaining the title to the land. The developers, therefore, cannot be permitted to take the benefit of their own wrongs and get richer at the expense of the buyers,” observed the forum.
The complainant, Ajay Kumar, a resident of Jaipur, applied for a residential flat with Parsvanath Developers Limited and deposited Rs 10.42 lakh as earnest money along with the application form. However, the developer failed to make any development at the site and the complainant sought cancellation of the allotment and refund of the earnest money along with interest.
Parsvanath Developers Limited, however, pleaded that if the complainant wanted the refund, he had to apply for the cancellation of the allotment and in that eventuality Rs 5,90,750, the five per cent of the basic price of the flat would be forfeited.

Schoolboy kept in ‘solitary confinement’ for over a week

Nabha, September 2
The parents of a Class X student had to approach the Punjab and Haryana High Court to meet their son. Reads weird but the strange route had to be actually taken by Gurnek Singh whose 16-year-old son Sukhwinder, a hosteller, was allegedly kept in solitary confinement by the Punjab Public School (PPS), Nabha, for the past over a week.
For their part, the school authorities said the allegations were baseless. The high court has also issued a contempt notice to Nabha SDM and marked an inquiry to the Secretary, Education (Punjab), into the complaints of alleged harassment of students by the school management.
Gurnek Singh, a resident of Phillaur, Jalandhar, said: "My son was illegally detained on the school premises at the behest of some school officials. We filed a habeas corpus for his release after the school authorities refused to listen to our plea."
A police team led by Nabha SHO GS Sikand along with SDM Poonam Deep visited the school premises and pressed upon the school authorities to hand over Sukhwinder's custody to his parents. "His parents are now happy and they have met the child in our presence as per the court orders," said Sikand.
Sukhwinder was allegedly kept in solitary confinement for over a week as punishment, said Gurnek. "Despite repeated attempts, the school authorities did not allow us to meet him nor was he allowed to attend the school. We were left with no option but to approach the court," he said.
Gurnek alleged that they approached the SDM regarding the issue for two days at her house and even tried to contact her over the phone, "but she refused to listen to our plea despite the court order".
According to the legal notice slapped by Gurnek on the school headmaster: "On August 22, Gurnek's wife Baljit Kaur visited the school to drop her second son Gurjinder. Sukhwinder requested housemaster BR Gordon to allow him to meet his mother. But instead of granting permission, the school officials, including BR Gordon, RS Sodhi and Rajesh Rai, mercilessly started beating Sukhwinder Singh…. The assailants physically pushed my wife, assaulted her and outraged her modesty and later abused my son and my wife." 

School Principal denies allegation

PPS headmaster Jagpreet Singh claimed that Sukhwinder approached his housemaster for a 'market slip', which was not issued to him as it was against school rules. "Following this, Sukhwinder abused and hit his housemaster in the presence of his mother and teachers. After an inquiry, the student was found guilty," Jagpreet said.
